California Waiver Through Date Examples

Use these examples to avoid over-waiving rights. The Through Date should match the labor/material period covered by the payment.

Example 1: Monthly Progress Billing

Invoice period: January 1, 2026 to January 31, 2026

Use Through Date: January 31, 2026

Do not use payment received date if work period ended earlier.

Example 2: Mid-Month Draw

Invoice period: February 1, 2026 to February 15, 2026

Use Through Date: February 15, 2026

If the draw only covers half the month, the Through Date should stop there.

Example 3: Final Payment

Final scope completion: March 20, 2026

Use Through Date: March 20, 2026

For final waivers, Through Date usually matches project completion date for billed scope.

Quick Rules

  • Match Through Date to the covered work/material period, not assumptions.
  • When in doubt, use a narrower date range to avoid over-releasing rights.
